We collect several types of information from and about users of our Website and products and services and those individuals that interact with us. Distance Information

When you use our Site, we may collect your location from the GPS, Wi-Fi, and/or cellular technology on your device to determine your location and your distance from our retail location(s) that sells our products.

To understand our users and provide tailored services. In some contexts, our use is also based upon your consent to provide us with geo location information.

Financial or Payment Information

We may collect payment information, such as your name and credit card, from you. However, Glik’s uses third party payment processors to complete the transactions and only maintains the last four digits of your credit card number.

We use this information for processing or fulfilling orders and transactions through our third-party payment processors.

Mobile Devices

We collect information from your mobile device such as unique identifying information broadcast from your device.

We use this information to identify unique visitors and understand how users interact with us on their mobile devices.

Mailing List

When you sign up for one of our mailing lists we collect your email address or postal address.

To share information about our products or services with you. We disclose information about our products and services with individuals that consent to receive such information, as well as deliver coupons.

Social Media Information

We may collect, as a result of using third party social media plugins, widgets, or other tools, information related to your social media usage as it relates to our Site.

We may use this information to save your preferences if you choose to share products on our Site on Social Media or generate content that we are tagged in on your social media.

Ratings and Reviews

When you rate or review us or our products, we collect any information you provide as part of that rating or review.

We use this information to improve and provide feedback on products.

Surveys

When you participate in a survey, we collect information that you provide through the survey. If the survey is provided by a third-party service provider, the third party’s privacy policy applies to the collection, use, and disclosure of your information.

When you participate in a sweepstakes or contest, we collect information about you which includes contact information to notify you if you are selected. We also collect information from you when we offer sweepstakes or contests via social media.

We use this information to operate the sweepstakes. In some contexts, we are also required by law to collect information about those that enter into our sweepstakes. By participating, you are automatically enrolled in our mailing lists. We also use this information to offer you contests or sweepstakes via social media.

Website Interactions

We use technology to monitor how you access and interact with our website. This may include which links you click on, or information that you type into our online forms. This may also include information about your device or browser.

We use this information to understand how you interact with our website to better improve it, and to understand your preferences and interests in order to select offerings that you might find most useful. We also have a legitimate interest in detecting and preventing fraud.

Web Logs

We collect information, including your browser type, operating system, Internet Protocol (IP) address (a number that is automatically assigned to a computer when the Internet is used), domain name, click-activity, referring website, and/or a date/time stamp for visitors.

We use this information to monitor our networks and understand behavior patterns of visitors to our websites. This allows us to improve our browsing and shopping experiences.

 

Further, you may elect to receive text/SMS communications from us, which may include marketing communications. When you sign up to receive text/SMS messages, we will send you information about promotional offers and other information relating to your relationship with us. These messages may use information automatically collected based on your actions while on our Website and may prompt messaging, such as messages notifying you that items have been left in your online cart. To the extent that you voluntarily opt to receive text/SMS notifications directly to your mobile phone, we receive and store the information you provide, including your telephone number or information about when you read a text/SMS messages. Information We Collect Through Automatic Data Collection Technologies 

As you navigate through and interact with our Website, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns, including:

  • Details of your visits to our Website, including traffic data, location data, activity logs, and other communication data and the resources that you access and use on the Website.
  • Information about your computer and internet connection, including your IP address, operating system, and browser type.

We also may use these technologies to collect information about your online activities over time and across third-party websites or other online services (behavioral tracking). Do Not Track (“DNT”) and Global Privacy Control (“GPC”) are privacy preferences that users can set in their web browsers. We may also disclose your Personal Data:

  • To enforce or apply our Terms of Use and other agreements, including for billing and collection purposes.
  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of the Company, our customers, or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction.

None of the above categories include (and all specifically exclude) text/SMS messaging originator opt-in data and consent; this information is not, and will not be, disclosed to any third parties.

Choices About How We Use and Disclose Your Information

We strive to provide you with choices regarding the Personal Data you provide to us. We have created mechanisms to provide you with the following control over your information:

  • Tracking Technologies and Advertising. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. If you disable or refuse cookies, please note that some parts of this site may then be inaccessible or not function properly.
  • Disclosure of Your Information for Third-Party Advertising. If you do not want us to share your Personal Data with unaffiliated or non-agent third parties for promotional purposes, you can opt-out by clicking our Do Not Share My Personal Information link found in the footer of our Website. You can also always opt-out by sending us an email with your request to privacyrequests@gliks.com or filling out a Privacy Request. 
  • Promotional Offers from the Company. If you do not wish to have your email address/contact information used by the Company to promote our own or third parties’ products or services, you can opt-out by unchecking the relevant box located on the form on which we collect your data or at any other time by logging into the Website and adjusting your user preferences in your account profile by checking or unchecking the relevant boxes or by sending us an email stating your request to privacyrequests@gliks.com. If we have sent you a promotional email, you may send us a return email opting out from future email distributions or opting out through the unsubscribe link at the bottom of email. This opt out does not apply to information provided to the Company as a result of a product purchase, warranty registration, product service experience or other transactions.

We do not control third parties’ collection or use of your information to serve interest-based advertising. However, these third parties may provide you with ways to choose not to have your information collected or used in this way. You can opt out of receiving targeted ads from members of the Network Advertising Initiative (“NAI”) on the NAI’s website.

Accessing and Correcting Your Information

You can review and change your Personal Data by logging into the Website and visiting your account profile page.

You may also use our Privacy Request portal or contact us at 1-800-454-5181 or privacyrequests@gliks.com to request access to, or correction of, any Personal Data that you have provided to us. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

You also may provide information to be published or displayed (hereinafter, “posted”) on public areas of the Website, or transmitted to other users of the Website or third parties (collectively, “User Contributions”). If you delete your User Contributions from the Website, copies of your User Contributions may remain viewable in cached and archived pages, or might have been copied or stored by other Website users. Proper access and use of information provided on the Website, including User Contributions, is governed by our Terms of Use.

We evaluate the following criteria in determining the minimum length of time that your Personal Data must be retained: (i) the purposes for which the data was collected; (ii) your reasonable expectations regarding the retention of your Personal Data; (iii) the risk associated with retaining your Personal Data; (iv) whether your Personal Data can be retained in another format (e.g., deidentified); and (v) legal obligations. Following the expiration of an applicable retention period, we may deidentify, aggregate, or anonymize data instead of deleting the data where permitted by applicable law.

For the purposes of this Section, “Personal Data” does not include information specifically excluded from the scope of applicable data protection laws, such as certain publicly available information deidentified or aggregated consumer information or health or medical information covered by the Health Insurance Portability and Accountability Act of 1996 (HIPAA).

We do not collect any Sensitive Data of consumers. We have not sold any Personal Data consumers in the last 12 months. We only share Personal Data for cross-context behavioral advertising/ targeted advertising through the cookies and other similar technologies operating on our Website.

The Glik Company obtains the categories of Personal Data listed above from the following categories of sources:

  • Directly from you. For example, from forms you complete or products and services you purchase.
  • Indirectly from you. For example, from observing your actions on our Website.
  • From our affiliates and subsidiaries.
  • From third party sources, including information from commercially available sources, such as public databases and data aggregators.

We may disclose your Personal Data to a third party for a business purpose. When we disclose Personal Data for a business purpose, we enter into a contract that describes the purpose and requires the recipient to both keep that Personal Data confidential and not use it for any purpose except performing the contract. We disclosed this Personal Data for a business purpose to the following categories of third parties:

  • To contractors, service providers, and other third parties we use to operate or support our business;

Applicable law prohibits third parties who receive the Personal Data from reselling or resharing it unless you have received explicit notice and an opportunity to opt-out of further sales or sharing.

None of the above categories include (and all specifically exclude) text/SMS messaging originator opt-in data and consent; this information is not, and will not be, disclosed to any third parties.

A.   Access to Specific Information and Data Portability Rights. You may have the right to request that we disclose certain information to you about our collection and use of your Personal Data. Once we receive and verify your request (please see Subsection Exercising Access, Data Portability, Correction, and Deletion Rights below for more information), we will disclose to you, as applicable:

        • The categories of Personal Data we collected about you.
        • The categories of sources for the Personal Data we collected about you.
        • Our business or commercial purpose for collecting or sharing that Personal Data.
        • The categories of third parties with whom we disclose that Personal Data.
        • The specific pieces of Personal Data we collected about you (also called a data portability request).
        • If we sold, shared or disclosed your Personal Data for a business purpose, two separate lists disclosing:
          • the Personal Data categories that we sold and for each category identified, the categories of third parties to whom we sold that particular category of Personal Data (we have not sold any Personal Data); and
          • the Personal Data categories that we disclosed for a business purpose and for each category identified, the categories of third parties to whom we disclosed that particular category of Personal Data.

B.  Correct Specific Information. You may have the right to request that we correct inaccurate Personal Data about you. Once we receive and verify your request (please see Subsection Exercising Access, Data Portability, Correction, and Deletion Rights below for more information), we will use commercially reasonable efforts to correct the information to comply with your request. Not all state privacy laws may afford this right to their residents.

C.  Deletion Request Rights. You may have the right to request that we delete any of your Personal Data that we collected from you and retained, subject to certain exceptions. Once we receive and verify your request (please see Subsection Exercising Access, Data Portability, Correction, and Deletion Rights below for more information), we will delete (and direct our service providers to delete) your Personal Data, unless an exception applies. In responding to your request, we will inform you whether or not we have complied with the request, and, if we have not complied, provide you with an explanation as to why.


We may deny your deletion request as permitted by applicable law. For example, we may deny your deletion request if retaining the information is necessary for us, or our service provider(s), to:

      • Complete the transaction for which we collected the Personal Data, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you.
      • Help to ensure security and integrity to the extent the use of your Personal Data is reasonably necessary and proportionate for those purposes.
      • Debug products to identify and repair errors that impair existing intended functionality.
      • Exercise free speech, ensure the right of another consumer to exercise his/her free speech rights, or exercise another right provided for by law.
      • Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. seq.).
      • Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information’s deletion may likely render impossible or seriously impair the research’s achievement, if you previously provided informed consent.
      • Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.
      • Comply with a legal obligation.

D.   Personal Data Sharing Opt-Out and Opt-In Rights. Pursuant to applicable law, you have the right to direct us to not sell or share your Personal Data at any time (the “right to opt-out”). As used herein, “share” refers to sharing for purposes of cross-context behavioral advertising or targeted advertising, as contemplated under applicable law.

We do not have actual knowledge that we sell or share the Personal Data of consumers under 16 years of age. We do not sell or share the Personal Data of consumers we actually know are less than 16 years of age, unless we receive affirmative authorization (the “right to opt-in”) from either the consumer who is between 13 and 16 years of age, or the parent or guardian of a consumer less than 13 years of age. Consumers who opt-in to Personal Data sharing may opt-out of future sharing at any time.

To exercise the right to opt-out, you (or your authorized agent) may submit a request to us by visiting the “Do Not Share My Personal Information” link found in the footer of our Website. The link will take you to our cookie consent manager which will allow you to disable all cookies (except the necessary cookies) which will discontinue the sharing of your Personal Data.

You may also exercise the right to opt-out using an opt-out preference signal in a format commonly used and recognized by businesses, such as through an HTTP header field. When we receive an opt-out preference signal, we will treat it as a valid request to opt-out of the sharing for that browser or device sending the signal, and, if known, for the consumer.

Once you make an opt-out request, we will wait at least twelve (12) months before asking you to reauthorize Personal Data sharing. However, you may change your mind and opt back in to Personal Data sharing at any time through our cookie consent manager which can be found at:

You do not need to create an account with us to exercise your opt-out rights. We will only use Personal Data provided in an opt-out request to review and comply with the request.

E.   Exercising Access, Data Portability, Correction and Deletion Rights. To exercise the access, data portability, correction, and deletion rights described above, please submit a consumer request to us through one of the following:

          • Calling us at 1-888-914-9661 with the PIN number 067326.
          • Visiting our Privacy Request portal.
          • Logging into your account and making the appropriate revisions.

When you use a request method above, we will request certain information for verification purposes, such as your name, address, and e-mail address. We will use this information to verify this is a permitted request, such as by matching your name and address with information in our records. Depending on the type of request, we may require a certain number of data points to allow for verification.

Only you, or a person properly authorized to act on your behalf, may make a verifiable consumer request related to your Personal Data. You may also make a verifiable consumer request on behalf of your minor child.  

An authorized agent may make a request on your behalf using the request methods designated above. Additionally, if you use an authorized agent to submit a consumer request, we may require the authorized agent to provide proof that you gave the agent signed permission to submit the request. We may also require you to verify your own identity directly with us or directly confirm with us that you provided the authorized agent with permission to submit the request.

 

The verifiable consumer request must:


          • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected Personal Data or an authorized agent of such person.
          • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with Personal Data if we cannot verify your identity or authority to make the request and confirm the Personal Data relates to you.

Making a verifiable consumer request does not require you to create an account with us. We will only use Personal Data provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.

If we deny your request, you may have the right to appeal our decision. Further, if you appeal and your appeal is denied, you may have the right to complain to your state’s attorney general. You may appeal your decision by contacting us by email at privacyrequests@gliks.com, through our Privacy Requests portal or by calling us at 1-888-914-9661 with the PIN number 067326.

F.    Response Timing and Format. In accordance with applicable law, we endeavor to respond to a consumer request within forty-five (45) days of its receipt. If we require more time (up to 45 additional days), we will inform you of the reason and extension period in writing. We will deliver our written response by mail or electronically, at your option. We will also notify you following the correction of inaccurate information, or the deletion of Personal Data.

The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your Personal Data that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

You may make a consumer request for access or data portability free of charge twice within a 12-month period. Additional requests may be subject to a fee. We may charge a fee to process or respond to your consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

G.   Non-Discrimination. We will not discriminate against you for exercising any of your rights. Unless permitted by applicable laws, in connection with you exercising your rights, we will not:

          • Deny you products or services.
          • Charge you different prices or rates for products or services, including through granting discounts or other benefits, or imposing penalties.
          • Provide you a different level or quality of products or services.
          • Suggest that you may receive a different price or rate for products or services or a different level or quality of products or services.

However, we may offer you certain financial incentives permitted by applicable laws that can result in different prices, rates, or quality levels. Any legally-permitted financial incentive we offer will reasonably relate to your Personal Data’s value to us and contain written terms that describe the program’s material aspects. Participation in a financial incentive program requires your prior opt in consent, which you may revoke at any time.

H.  Other California Privacy Rights. California Civil Code Section § 1798.83 permits California residents to request certain information regarding our disclosure of personal data to third parties for their direct marketing purposes.
